Tata Consultancy Services (TCS) is facing allegations of visa fraud wherein whistleblowers claimed that the company misused special work visas to avoid intense scrutiny under U.S. labour laws. As reported by Bloomberg news, TCS deliberately used L-1A manager visas to bring frontline workers to the US while labelling them as managers.

What happened before?

Former IT manager for TCS in Denver Anil Kini claimed that company executives instructed to falsify internal organisational charts, Bloomberg reported. The Company aimed at misrepresenting frontline employees as managers, thereby evading federal scrutiny.

Previously, Anil Kini and other two employees filed a lawsuit under the federal False Claims Act by accusing the company of misusing the L-1A visa system. Notably, these visas are less regulated than H-1B skilled-worker visas, which have stricter wage requirements.

As per Equal Employment Opportunity Commission (EEOC), TCS had 31,000 US-based employees, less than 600 held executive or managerial positions. However, in the same year TCS received approvals for 1,969 new or renewed L-1A manager visas. In 2021, the company reported having 564 executives and managers in the US but obtained 1,447 L-1A visa approvals.

What did TCS say?

TCS have denied any such wrongdoings. A company spokesperson said, “TCS does not comment on ongoing litigation, however we strongly refute these inaccurate allegations by certain ex-employees, which have previously been dismissed by multiple courts and tribunals. TCS rigorously adheres to all US laws.”

Immigration attorneys have highlighted that forging job titles to secure L-1A visas for employees who are not managers violates the Immigration and Nationality Act.
