The District Consumer Disputes Redressal Commission II Hyd has ordered the Telangana Rajiv Swagruha Corporation Limited (TRSC) and the Hyderabad Metropolitan Development Authority (HMDA) to jointly pay a Rs 1 lakh refund and Rs 10,000 compensation to the complainant for failing to return the 'open parking' amount deposited by her after cancelling the allotment of flat.

Furthermore, the authority has ruled that the one lakh refund be paid along with 9% interest per year from July 22 to the date of the order.

The complainant, Ch Girija, a Vanasthalipuram resident, paid Rs 3 lakh for the allotment of a 3 BHK apartment in Bandlaguda in July 2022.

It all started when Girija received a letter of allotment-cum confirmation from the housing corporation and HMDA. In the letter, they asked her to pay the outstanding sum by October 12, 2022, mentioning that if she failed to pay the full amount, the token money she paid earlier would be forfeited, and the flat she was given would be revoked and assigned to another person. However, she failed to pay the whole sum and received a cancellation notice.

However, when the matter came to light, the consumer forum determined that only Rs 3 lakh of the complainant's total payment should be considered a token value, with the remaining Rs 1 lakh for open parking to be returned plus interest.

Given the circumstances, the forum asked the bodies to pay the amount within 45 days of November 12.
