Raj Bhavan Staffer Accuses West Bengal Governor of Molestation

Molestation charges against West Bengal Governor, CV Ananda Bose, have been alleged by a contractual staffer. However, due to constitutional immunity, he cannot be prosecuted while in office, as per Article 361. This provision shields Governors and Presidents from legal action during their term, ensuring they are not answerable to courts for their actions.
This immunity was upheld in the 2006 case Rameshwar Prasad vs. Union of India, which emphasised that Governors are shielded even from personal malfeasance accusations. Despite this, there have been instances where criminal actions were halted until the Governor's term ended.
For example, in 2017, criminal charges against BJP leaders in the Babri Masjid demolition case proceeded, except for then-Governor Kalyan Singh. Similarly, Meghalaya Governor V Shanmuganathan resigned in 2017 over sexual harassment allegations.
Regarding the recent case, TMC leaders claimed that a woman accused the Governor of molestation. In response, the Governor denied the allegations, asserting his commitment to fighting corruption and violence in Bengal. Police are currently investigating the complaint.
Women and Child Development Minister Shashi Panja condemned the Governor's alleged actions, criticising him for misusing his position to harass a woman. She urged Prime Minister Narendra Modi to address the issue during his Bengal rallies.
The situation raises questions about accountability and legal recourse for allegations against constitutional authorities. While immunity protects them during their term, it also raises concerns about impunity. However, the law ensures that legal action can be pursued once they vacate office. The case highlights the complex interplay between constitutional immunity, accountability, and justice in cases involving high-ranking officials.
