Plot registration still lingering for 18yrs

Pune: Eighteen years have gone by, still the developer of Sairung Woods property in Pune has not registered the plots despite the owners' agreements as the value of the plot has become high.
This is the plight of 40 plot owners in a project called Sairung Woods situated at Rajiv Gandhi Infotech Park at Maan village in Mulshi Taluka, Pune district. The project was launched by Sairung Developers whose Chairman is KR Malik. These 40 plot owners had purchased these plots during 2003-04 after paying full consideration amount through notorised agreements. The developer did not register the plots then and had promised to register the plots soon. However, 18 years have gone by and still the builder has not registered the plot owners' agreements.
These plots were purchased generally by IT professionals /engineers/doctors/entrepreneurs /Defence officers and various other professionals with an intention to develop it and start some venture on their own. However, due to the continuous cheating and other criminal activities of Sairung Developers these plots and vast amount of skills, capabilities & aspirations have been locked up for the past 18 years.
As per the allegation levelled by the plot owners, the developer did not register the plots in the plot owners' names, although they have taken the entire consideration amount for the said plots.
The builder in a statement has said that they could not register the plots in the names of the plot owners because of MIDC reservations.
However, the plot owners are not ready to buy the idea. They cite a Bombay High Court Aurangabad Bench judgment, whereby it has been made clear that if there is no notification under said section 32, then owner can transfer his property by registered document. MIDC has also confirmed the above through many letters.
"While Sairung Developers is making false statements in court that they could not register the plots because of MIDC reservation, they themselves have been registering sale deeds and have even mortgaged our land illegally and without our consent since 2009," the representatives of the plot owners Randhir Sinha, Sudarshan Singh and Yeshwant Deshpande told Bizz Buzz.
The malicious intent behind such criminal action to grab our plots is because the value of plots has skyrocketed in the last 18 years because of full-fledged development of Hinjewadi IT Park. At one point in time they also accepted to register the plots and asked us to submit all agreements, but when news of metro line passing in front of our plots came then Sairung Developers started fabricating more lies to avoid registering the land in our names, they added.
The plot owners have got fed up with the cheating and harassment of the developer for the past 18 years and therefore approached the then state chief minister, Devendra Fadnavis in 2018. Fadnavis promptly ordered the police to investigate. The police filed the plot owners first FIR in Dec 2018. As a result, the developer was arrested but soon released on the false plea that registration was not possible because of MIDC reservation.
After a long time, the Chatursinghi Police station filed charge sheet which is pending before JMFC court. As per the plot owners, the chargesheet is incomplete and a lot of charges like double selling/illegal mortgage which could have been put against the developer, were not put. Even the provisions of the Maharashtra Protection of Interest of Depositors (MPID) which could have been applied were not applied.
"The developers had already resold lot of our plots to other people," alleged the representatives of the plot owners.
In these cases, the plot numbers in both the sale deeds was same and the crime was very obvious. To avoid this and to continue reselling the plots already sold, the developer made a new layout which had different plot numbers as compared to the original layout. Now, they have started selling plots as per the new layout and one case where our plot has been resold using a new plot number has already come to light and FIR has already been filed in this regard, they said.
Seventeen plot owners, who were not able to file FIR earlier, filed a complaint with DCP EoW Pune city on January 15. However, EoW Pune city did not file a FIR and therefore we have taken this matter to court. The hearing in the court is going on and the judgment of the court is awaited, they said.
