Non-implementation of RERA RCs: Antriksh Sanskriti homebuyers disgusted

Ghaziabad: The hapless homebuyers of the stalled Antriksh Sanskriti housing project on NH-24 are disillusioned with the Ghaziabad administration for its inability to implement Recovery Certificates (RCs) issued by UPRERA. They deplore that the district administration has not taken any coercive action against Antriksh Realtech Pvt Ltd for failing to comply with countless orders of UP RERA in the matter of Antriksh Sanskriti project.

Expressing their disappointment over the non-implementation of RCs, the aggrieved homebuyers have sought judicial intervention. "The Allahabad High Court has issued orders to DM Ghaziabad several months ago to ensure the recovery of more than 12 RC amounts of petitioners," said a cheated homebuyer of Antriksh Sanskriti adding that the administration has failed to prove its accountability towards the citizens, despite the court's directions.

The Ghaziabad bureaucracy, according to suffering homebuyers, is still acting with a colonial mindset. "It is unfortunate that even after receiving orders of the Hon'ble High Court to ensure realisation of RCs, the district administration is not taking concrete action. It is worth noting that more than 50 RCs issued by UP-RERA to homeless buyers who were duped in the delayed Antriksh Sanskriti project for more than a decade have been gathering dust in the DM & Tehsildar Ghaziabad offices for years without any action," conveyed a duped homebuyer of Antriksh Sanskriti.

Many exploited homebuyers have been compelled to approach the Allahabad High Court for issuance of contempt of court notices to the district administration. It is to be seen now whether the Ghaziabad administration offices take any action even after receiving the contempt of court notices in Antriksh Sanskriti case, of late.

"The Ghaziabad administration has not prescribed any time limit to ensure the execution of RCs issued by UPRERA. The Ghaziabad Tehsildar's office is only casually handling the complaints of homebuyers on the Uttar Pradesh Chief Minister's Jan Sunwai Portal by always stating that efforts are on to ensure compliance of RCs, despite the fact that these so-called efforts have not yielded any results over the years."

When RCs are not executed, RERA only levies some nominal amount of penalty but even this amount remains unrecovered. In some cases, if it gets recovered, it goes into the treasury of RERA, leaving complainants high and dry," rue Antriksh buyers. They ask why UP-RERA is not recommending the arrest, confiscation and e-auction of movable and immovable properties of all company directors of the defaulting real estate company.

According to them, UP-RERA should stop blaming the district collectors for non-compliance of RCs as it too fails to take any coercive steps against the defaulting builders. "Why can't UP-RERA prevent such builders from taking up future real estate projects until they clear their dues in respect of RCs issued to aggrieved buyers?" they wonder.

As RCs of homebuyers have not been executed by the Ghaziabad district administration, they are facing severe financial crisis due to their lifetime savings stuck in this stalled project. They have written several letters requesting the Chief Minister's Office of Uttar Pradesh to ensure the implementation of RCs and save their lives. They contend that the grievances should be disposed of only if their RCs are executed in totality as per the RERA Act 2016. They are hopeful that the UP government will fulfill its constitutional duty to protect their right .for a roof over their heads.
