Following a week spent in detention due to insurrection charges related to his brief declaration of Martial Law, South Korean President Yoon Suk Yeol has had his arrest warrant canceled by the court.

Yoon's lawyers have stated that while the president won’t be released from custody right away, prosecutors have the option to appeal the ruling. If he is released directly, the court's decision would allow Mr. Yoon to face his criminal trial without being physically detained between hearings.

The whole event started when, in January, President Yoon was arrested and charged with insurrection after issuing a martial law declaration on December 3rd. This action sparked significant public outcry in Seoul, leading lawmakers to swiftly vote against it and repeal it within hours.

Mr. Yoon claims he was acting to root out "anti-state" elements and never planned to totally establish emergency military rule.

His legal team contended that the warrant issued on January 19 was unlawful, arguing that the prosecutor's request was flawed in its procedure. “South Korea’s rule of law is still alive, said Yoon's attorneys shortly after the Seoul Central District Court's ruling on Friday.

It’s important to note that Yoon’s criminal charges are separate from his impeachment trial. The Constitutional Court, the highest court in the country, is anticipated to deliver a verdict in the coming weeks regarding whether to uphold his impeachment or reinstate him to office.

The ruling on Friday allows Yoon to await the outcome of his impeachment at home instead of from behind bars.

Kwon Young-se, chairman of Yoon’s ruling People Power Party, welcomed the court’s decision on Friday, calling it “an important moment to confirm that the rule of law and justice of the Republic of Korea is alive.” He added that he hopes the Constitutional Court “will make a fair and just ruling based solely on constitutional values” during the impeachment trial.
