The U.S. Citizenship and Immigration Services (USCIS) has completed the selection process for H-1B visa registrations for the 2026 fiscal year. All selected beneficiaries have been notified, and now it’s time for them to file their H-1B petitions.

Who Can File?

Only individuals whose registrations were selected are eligible to file H-1B cap-subject petitions, including those who qualify for the advanced degree exemption.

Filing Period

The filing window is at least 90 days, running until June 30, 2025.

You can submit your petition no more than six months before the employment start date you request.

How to File Your H-1B Petition

Complete Form I-129:

This form, known as the Petition for a Nonimmigrant Worker, must be properly filled out and submitted.

Only the latest version of Form I-129 (dated 01/17/25) is accepted. Older versions will be rejected.

Submit Your Petition Online or by Paper:

USCIS now allows online filing for H-1B cap petitions and Form I-907 (premium processing request).

If you prefer paper filing, submit the petition to the correct USCIS lockbox facility or Texas Service Center (TSC).

Note: Paper-filed petitions cannot be linked to an online account.

Include All Required Documents:

H-1B Registration Selection Notice (proof that your registration was selected).

Beneficiary Confirmation Number (entered in the H Classification Supplement).

A copy of the beneficiary’s passport or travel document used for registration.

Certified Labor Condition Application (LCA) from the U.S. Department of Labor, which must match the job position in your petition.

Pay the Required Fees:

Fees vary based on the type of petition.

The H-1B registration fee has increased to $215 for FY 2026.

Payments can be made by check, money order, or credit card/ACH transfer for online filings.

Use separate checks for each fee if paying by check or money order.

Important Reminders

The start date on your petition must be October 1, 2025, or later (but no more than six months from the receipt date), or it may be rejected.

Ensure that all details in your petition match the information submitted during the electronic registration process. If there are discrepancies, include an explanation and supporting documents.

If filing Form G-28 (legal representation), make sure the petitioner’s name matches the one listed on Form I-129.

By following these steps carefully, you can successfully file your H-1B cap-subject petition and move closer to securing your work visa for FY 2026.
